Data protection declaration for Marina Gastro AG

  1. General / introduction
    We, Marina Gastro AG (hereafter also referred to as “Marina Lachen”), want to ensure you have the best possible experience. We use the personal data which you provide to improve our services and your experience. This data protection declaration will give you insight into how we use the personal data you supply, and our promise to protect them. It is also about the rights and opportunities you have to check your personal data and protect your privacy. In addition, it outlines what personal data we collect from you when you visit our websites (www.marinalachen.ch / www.heimetli-lachen.ch / www.privatsphären.ch), how we use your personal data, and the third parties to which we may disclose them.
  2. Privacy / collection and processing of personal data
    In principle, you can visit our websites without telling us who you are. Our web servers automatically store information of a general nature. This includes the type of web browser, the operating system used, the domain names of the Internet service providers, the website from which you are visiting us, as well as the date and duration of the visit. This only includes information that is not identifiable to you personally. We analyse this data for statistical purposes and in anonymous form only. For example, we do not link any specific visit to our website with a particular IP address. There are also additional applications on our site for which you must register. (We collect your personal information if you wish to book a room. We then use this information for a few reasons: to contact you if require more information from you or to provide you with further information; also, to check whether our records are correct).

    Marina Gastro AG uses so-called “cookies”, i.e. text files or so-called “web beacons”, i.e. graphic files that are saved on the user’s display device. This is technology that can be used to collect certain user-specific settings and technical information that can identify the user. This information shows when and how users utilise the website and enables continuous improvement. The use of cookies offers users the advantage that when completing forms on the website they do not have to keep entering their personal details. Google will also transmit this information to third parties insofar as this is required by law, or where third parties process these data on behalf of Google. Google will not link your IP address with other Google data under any circumstances. You can also prevent the installation of cookies here by setting your browser software accordingly (see point 3). By using this website, you agree to the processing of the data Google has collected from you (in the way already described and for the abovementioned purpose). You can object at any time with future effect regarding the collection and use of your IP address by Google Analytics.

    This website uses Google Maps to display maps and to create route maps. Google Maps is powered by Google Inc. By using this website, you agree to Google or one of their representatives or third-party providers, collecting, processing and using data collected automatically in addition to data you have entered.

    6.1 Agreement
    By registering for the newsletter, the user declares their agreement to regularly receive a newsletter via e-mail with information on news, special promotions and offers from Marina Lachen (as well as articles on the topic of hotels, travel, cuisine and overnight stays). The personal data we process to send the newsletter will only be passed on to third parties insofar as this is required for the despatch of the newsletter or based on legal provisions. This agreement to the use of the e-mail address can be revoked at any time with future effect, for example by sending an e-mail to marketing@marinalachen.ch. Furthermore, there is always the option to unsubscribe from further receipt of the newsletter via a separate link to be found directly at the end of every newsletter.
    As a user, you have already given us your express consent when subscribing to the newsletter, and we have logged this:
    “I would like to subscribe to the free Marina Lachen newsletter and receive regular information about news, special promotions and offers from Marina Lachen. My e-mail address will only be passed to third parties within the scope of the legal provisions. My agreement to receive the newsletter can be revoked at any time with future effect.”
    6.2 Existing customer mail including post-stay e-mails
    Insofar as the user has registered on the Marina Lachen (www.marinalachen.ch) website and/or booked a hotel room, as a so-called existing customer they automatically receive an e-mail with an evaluation survey following a stay at our hotel, in addition to our regular newsletter. The user can revoke the use of their e-mail address for the receipt of the evaluation mail and the newsletter at any time with future effect. There is the option to unsubscribe via a separate link at the end of every newsletter or via e-mail to marketing@marinalachen.ch.
  8. Social plug-ins for Facebook
    We use social plug-ins for facebook.com, operated by Facebook Inc., 1601 Willow Road, Menlo Park, CA 94025, USA. For example, if you click on the “like” button or enter a comment, the relevant information is transmitted from your browser directly to Facebook and is stored there.     Our website may draw upon the techniques of partner companies such as booking.com to be able to implement its enquiries / bookings efficiently.

Our partner companies ensure that your data may only be processed and used for the purposes of consultancy, advertising and market research with your express permission.     In principle, children and young people should not transmit any personal data without the permission of their parents or guardian. Under no circumstances will Marina Gastro collect knowingly obtained personal data from children or young people with restricted legal capacity, or in any way use or disclose such to third parties.
  12. The purpose of the collection, processing and use of data
    Operation of our hotel as well as all transactions associated with this
    - Operation of the restaurants of Marina Lachen as well as all related transactions
    - Operation of a customer service centre (reception) for the purposes of accepting and making bookings
    - Additional purposes are accompanying or supporting functions with regard to staff, agents, supplier and service administration
    - There is video surveillance in the hotel exclusively for collecting proof of vandalism, break-ins, attacks or other offences.
    - The presence and use of video cameras are indicated by the relevant notices.
    - The collection, processing and use of data is carried out for the execution of the purposes mentioned previously.
  13. Description of the persons concerned and relevant data / data categories
    Data are primarily collected, processed and used for the following groups of persons:
    - Guest data (particularly address data, booking data, guest requirements and billing data)
    Customer data (particularly address data, contract data, billing and services data)
    - Prospect data (particularly accommodation enquiries, room and hall enquiries and address data)
    - Employee data, application data, data from pension institutions (existing staff and salary data)
    Agent / agency data (existing address, billing and service data)
    - Business partners and external service providers (particularly address, billing and service data)
    - Data on suppliers (particularly address, billing, service and function data)
    - Non-allocated groups of persons: video recording insofar as this is required to meet the purposes mentioned at point 11.
  14. Categories of recipients to whom data may be passed
    Hotels, guest houses and other accommodation providers may collect personal data from their guests and save it in automated processes, insofar as this is required in the context of the accommodation contract. This usually also includes billing data for food and drink, telephone calls made from the room and/or other hotel-specific services. Hotels and accommodation providers are obliged to ask for details of the residency, date of birth and nationality of their guests, based on the obligation to report.
    Furthermore, data may also be sent to the following recipients:
    - Public bodies that receive data based on legal provisions
    (e.g. social security institutions)
    - Internal departments involved in the execution and fulfilment of relevant business processes (e.g. staff management, accounting, marketing, sales, IT and the central booking service (customer service centre)
    - External contractors (service companies)
    - Other external bodies (e.g. credit institutions and partner companies, in the scope of the order activity granted by the customer)
  15. Standard deadlines for deleting data
    The legislator has a variety of retention obligations and periods. Once these terms have expired, the relevant data and data sets will be routinely deleted if they are no longer required to fulfil the contract (guest, rental and service contracts). The commercial or financial data from a completed financial year will then be deleted after another ten years according to the legal provisions, provided longer retention periods are not specified or are not required for justified reasons. In the field of staff administration and management, shorter deletion periods are used in certain areas. This applies in particular to rejected applications or written warnings. Insofar as data for this are not affected, they will be deleted without notification upon the cessation of the purposes mentioned at point 11.
    Registration forms are retained according to the valid registration law in accordance with the prescribed minimum period. They are then sent for destruction according to data protection law under specific precautions.

    When you use our website, you give your agreement that we may store and use information you provide to us – naturally only as described here in these data protection provisions. It may be the case that we modify these provisions from time to time without notification. Please check every now and again to ensure you are in agreement with this. In this case, we will also inform the recipients of the data concerned about the adaptations we have made, unless this is impossible or involves disproportionate effort.

In individual cases, particularly in the case of statutory retention obligations, the right to erasure may be excluded. In this case, the erasure may be replaced by a blocking of the data if the requirements are met.
